Purpose of the Notice-and-Take-Down Procedure

Scam.SG relies on notifications from third parties to identify and address manifestly unlawful content on its website. The purpose of the Notice-and-Take-Down procedure is to notify Scam.SG of such content, which is deemed unlawful if there is no doubt about its evident unlawfulness from the content itself or further information made available to Scam.SG.

Handling Negative Reviews and Other Complaints

The Notice and Take Down procedure cannot be used to take reviews or other content offline purely because of its negative nature. Only content that is evidently unlawful will be considered for action.

Criteria for Taking Action

Scam.SG will only take action if it is clear at a single glance that the content is unlawful. It will never take action on the basis of a suspicion of unlawfulness.

Who Can File a Complaint?

Only the person on whom the content has an unlawful effect, or their representative such as their (legal) advisor, is entitled to start the Notice-and-Take-Down procedure.

When Can a Complaint Be Submitted?

A complaint may only be submitted after the complainant has attempted to contact the content provider directly by reasonable means and this contact has not led to a result. The complaint must be submitted through the specified channels, and unsubstantiated requests will not be considered.

How to Submit a Notice & Take Down Request
If you wish to submit a Notice and Take Down request, please send the following information:
  • Company name.
  • The URL of the company website to which the content or review relates.
  • Your first and last name.
  • Your phone number.
  • Your e-mail address.
  • The URL of the content on Scam.SG to which your request relates.
  • If it concerns a review also:
    1. The title of the review.
    2. The content of the review itself.
    3. The name of the reviewer.
    4. A clear substantiation of why the content is unlawful and the evidence proving it. For example, in the event of an infringement of an intellectual property right, you will have to enclose evidence showing that you are the rights holder.
    5. Your correspondence with the publisher about the content or review.
    6. Evidence showing that you are (or are the authorized representative of) owner of the Website.
    7. A description of exactly what you wish to achieve with this Notice and Take Down procedure.
Processing the Notice and Take Down Request

Once a Notice & Take Down request is submitted, Scam.SG will process the request. The request will only be handled if the complainant has provided sufficient information to clearly demonstrate that the content is unlawful. If the information is insufficient or the request is not substantiated, the Notice & Take Down request will be rejected, and the complainant will receive an automatic email notification.

Scam.SG will assess the content of the Notice & Take Down request and the related content to determine if it is unmistakably unlawful. Every effort will be made to provide a substantive response fourteen (14) business days upon receiving the complaint.

If Scam.SG cannot establish the unlawfulness of the content, the request will be rejected, and the complainant will receive confirmation via email. If Scam.SG concludes that the content is unlawful, appropriate action will be taken at its discretion.

Appealing the Outcome

If you wish to object to the outcome of the Notice and Take Down Procedure, you can do so by initiating a new Notice and Take Down procedure. This will only be dealt with substantively by Scam.SG if new evidence or means have been provided.

Prohibition of Threats and Abusive Behavior

Websites may not threaten, abuse, or blackmail users and reviewers. Scam.SG does not tolerate threats against its employees and considers such behavior a material breach, leading to immediate account blocking and reporting to relevant authorities.
